1. Acceptance of Terms

Welcome to PalQs! These Terms of Service ("Terms") govern your use of the PalQs mobile application and related services (the "Service") operated by PalQs mobile app ("we," "us," or "our").

By downloading, installing, or using PalQs, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Service.

2. Description of Service

PalQs is a social polling application that allows users to:

  • Create and participate in polls with friends and circles
  • Connect with friends and form social groups ("Circles")
  • Share images and multimedia content
  • Access premium features through subscriptions
  • Invite friends through contact sharing

3. User Accounts

Account Creation

  • You must provide accurate, current, and complete information when creating an account
  • You must be at least 13 years old to use PalQs
  • PalQs is designed for adults 18 years and older and is not intended for children
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

Account Security

  • You must immediately notify us of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms
  • You may delete your account at any time through the app settings

4. Subscription Terms

Premium Features

PalQs offers premium subscriptions that include:

  • Circle Premium: Unlimited poll creation within circles ($3.99/month or $36/year)
  • Motto Link: Ability to add clickable links to your motto ($9/month)
  • Q Credits: One-time purchase of poll creation credits (50 credits for $5)

Billing and Payment

  • Subscriptions are automatically renewed unless cancelled
  • Payment will be charged to your chosen payment method
  • Prices may change with 30 days advance notice
  • You can cancel subscriptions at any time through your account settings or the app store
  • Upon cancellation, you will retain premium features until the end of your current billing period
  • Refunds are generally not issued unless a billing error was made on our side
  • Refunds are subject to our discretion and applicable app store policies

Free Features and Credits

  • Free App: PalQs is free to download and use
  • Free Voting: Voting in polls is completely free and unlimited
  • Free Poll Credits: New users receive free poll posting credits upon signup
  • Promotional Credits: Additional free poll credits may be offered during promotions
  • Q Credits: Users can purchase Q credits to post polls without a circle subscription
  • Credit Features: Q credits are inexpensive, never expire, and are saved even after subscription cancellation
  • No Free Trials: Premium features do not offer free trial periods

How Circle Subscriptions Work

  • Main Circle Requirement: You must have an active main circle subscription to create additional circles
  • Cancellation Order: All extra circle subscriptions must be cancelled before you can cancel your main circle subscription
  • Access Loss Warning: If you cancel your main circle subscription, you will lose access to all extra circles when the main subscription expires, regardless of when individual extra circle subscriptions end
  • Resubscription Process: If you resubscribe to the main circle subscription, you can then resubscribe to individual extra circles or let them expire at their scheduled end dates
  • Non-Transferable: Circle subscriptions are not transferable between different circles
  • Subscription Management: Manage all your circle subscriptions through your account settings or the app store

5. User Content and Conduct

Acceptable Use Guidelines

PalQs is designed for creating and participating in polls within your social circles. You agree to use the app responsibly and in accordance with these guidelines:

  • Create polls that are appropriate for your intended audience
  • Respect the privacy and preferences of your circle members
  • Use poll options that are clear, relevant, and respectful
  • Respect voting decisions and avoid pressuring others to vote a certain way
  • Maintain appropriate boundaries in social interactions
  • When commenting on polls, engage respectfully and constructively with other users
  • Keep comments relevant to the poll topic and avoid spam or repetitive content

Your Content

  • You retain ownership of content you create (polls, votes, comments, images)
  • By using PalQs, you grant us a non-exclusive, royalty-free license to use, display, and distribute your content within the Service
  • You are responsible for ensuring your content doesn't violate these Terms or applicable laws

Prohibited Content and Conduct

You agree not to:

  • Post illegal, harmful, threatening, abusive, harassing, defamatory, or invasive content
  • Share pornographic, sexually explicit, or adult content
  • Share content that violates intellectual property rights
  • Spam, solicit, or engage in commercial activities without permission
  • Impersonate others or provide false information
  • Share personal information of others without consent
  • Attempt to hack, reverse engineer, or disrupt the Service
  • Use the Service to harm minors in any way
  • Share content that promotes violence, discrimination, or illegal activities
  • Create fake accounts or manipulate voting results

Content Responsibility and Reporting

  • User Responsibility: Users are solely responsible for the content they post
  • No Liability: PalQs owners are not responsible for content posted by users
  • Illegal Content: Users posting illegal content may be reported to law enforcement authorities
  • Mandatory Reporting: We may be required by law to report certain illegal activities to authorities
  • Cooperation: We will cooperate with law enforcement investigations when legally required

Content Moderation

  • We reserve the right to remove content that violates these Terms
  • We may suspend or terminate accounts for violations
  • Repeated violations may result in permanent account termination

6. Privacy and Data

Information Collection

  • Your use of PalQs is governed by our Privacy Policy
  • We collect information as described in our Privacy Policy
  • Contact access is optional and can be revoked at any time

Data Security

  • We implement reasonable security measures to protect your data
  • You acknowledge that no internet transmission is completely secure
  • You are responsible for maintaining the security of your account

7. Intellectual Property

PalQs Property

  • The PalQs app, including its design, features, and content, is the property of its owners
  • Our trademarks, logos, and brand elements are protected intellectual property
  • You may not use our intellectual property without written permission

User Rights

  • You retain rights to content you create
  • You grant us necessary rights to operate the Service
  • You represent that you have the right to share all content you post

8. Third-Party Services

PalQs integrates with third-party services including:

  • Google Sign-In for authentication (Android users)
  • Apple Sign-In for authentication (iOS users)
  • Payment processors for subscriptions
  • Analytics and crash reporting services
  • Cloud storage and database services

Your use of these services is subject to their respective terms and conditions.

9. Disclaimers and Limitations

Service Availability

  • We strive to maintain service availability but cannot guarantee uninterrupted access
  • The Service is provided "as is" without warranties of any kind
  • We reserve the right to modify or discontinue features with reasonable notice

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability is limited to the amount you paid for the Service in the past 12 months
  • We are not responsible for content posted by other users
  • We are not liable for damages caused by third-party services

User Responsibility

  • You use PalQs at your own risk
  • You are responsible for your interactions with other users
  • You should not rely solely on polls for important decisions

10. Indemnification

You agree to indemnify and hold harmless the app's owners, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of others
  • Content you post or share

11. Termination

By You

  • You may terminate your account at any time
  • Termination does not automatically cancel paid subscriptions
  • Some information may be retained as described in our Privacy Policy

By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account is inactive for an extended period
  • We discontinue the Service (with reasonable notice)

Effect of Termination

  • Your right to use PalQs ends immediately
  • We may delete your account and associated data
  • Provisions regarding liability, indemnification, and dispute resolution survive termination

12. Children's Safety

Age Requirements

  • PalQs is designed for adults 18 years and older and is not intended for children
  • You must be at least 13 years old to use PalQs (legal minimum)
  • Users between 13-17 should have parental permission
  • We may request age verification for compliance

Parental Rights and Responsibilities

  • Parents or legal guardians are responsible for monitoring the use of PalQs by minors under their supervision
  • Parents may request deletion of their child's account
  • We encourage parental involvement in children's online activities
  • Parents should review their child's poll content and social interactions
  • Report concerns about minors to our support team
  • Parents are responsible for ensuring their child's compliance with these Terms

Child Safety Standards

  • PalQs maintains comprehensive child safety standards to prevent child sexual abuse and exploitation

  • We actively monitor for and report any concerning content or behavior
  • All users must comply with our safety standards and report any violations

Reporting Safety Concerns

  • Users can report safety concerns through the in-app reporting feature
  • Emergency safety concerns should be reported to local law enforcement immediately
  • We cooperate fully with law enforcement investigations

13. International Use

Jurisdiction

  • These Terms are governed by applicable law
  • Any disputes will be resolved in appropriate courts
  • You consent to jurisdiction as specified

Export Controls

  • You agree to comply with applicable export control laws
  • You will not use PalQs in countries subject to embargo
  • You represent that you are not on any government restricted list

14. Changes to Terms

Updates

  • We may update these Terms from time to time
  • We will notify you of material changes through the app or email
  • Continued use after changes constitutes acceptance of new Terms
  • If you disagree with changes, you should stop using PalQs

Effective Date

  • Changes take effect when posted unless otherwise specified
  • The "Last Updated" date indicates when Terms were last modified

15. General Provisions

Entire Agreement

  • These Terms, along with our Privacy Policy, constitute the entire agreement
  • These Terms supersede any prior agreements or understandings

Severability

  • If any provision is found unenforceable, the remainder stays in effect
  • Unenforceable provisions will be modified to be enforceable while preserving intent

No Waiver

  • Our failure to enforce any right doesn't waive that right
  • Waivers must be in writing to be effective

Assignment

  • You may not assign your rights under these Terms
  • We may assign our rights with reasonable notice

Force Majeure

  • We are not liable for failures due to circumstances beyond our control
  • This includes natural disasters, government actions, or technical failures

17. Dispute Resolution

Informal Resolution

  • Contact us first to resolve disputes informally
  • We will work in good faith to address your concerns

Binding Arbitration

  • Disputes not resolved informally will be settled through binding arbitration
  • Arbitration will be conducted under applicable arbitration rules
  • You waive the right to participate in class action lawsuits
  • Small claims court disputes are exempt from arbitration requirements

Exceptions

  • Intellectual property disputes may be resolved in court
  • Injunctive relief may be sought in court when appropriate
  • Either party may seek court intervention to enforce arbitration awards

18. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of PalQs will be subject to the exclusive jurisdiction of the courts in the United States.
